TERMS AND CONDITIONS
1. Seller's Identity
The website nuleworld.com (hereinafter, the "Website") is managed by Nule S.r.l., with registered office at Via Tommaso Grossi 6, 20063 Cernusco sul Naviglio (MI), Italy. VAT number 14386290960 - REA MI - 2779464 - Email: info@nuleworld.com
(hereinafter, “Nule” or the “Seller”).
2. Scope of Application
These General Conditions of Sale (hereinafter, the “Conditions”) govern the offer, sale, and delivery of products marketed through the Website. Sales are made exclusively to consumers, i.e., natural persons acting for purposes unrelated to any entrepreneurial, commercial, craft or professional activity they may carry out. These Conditions apply to all sales made in Italy and in other European Union Member States. Placing an order implies full and unreserved acceptance of these Conditions.
3. Pre-contractual Information
Before the conclusion of the contract, the Customer receives the following information clearly and understandably:
- main characteristics of the products;
- total price including VAT;
- any shipping costs or other additional costs;
- payment methods;
- delivery methods and times;
- conditions, terms, and procedures for exercising the right of withdrawal;
- existence of the legal guarantee of conformity.
4. Nature of Products
The products marketed consist of clothing items and accessories. The images on the website are for illustrative purposes. Any non-substantial differences do not constitute a lack of conformity.
5. Conclusion of the contract
The order placed by the Customer through the Website constitutes a binding contractual offer. The contract is considered concluded when the Customer receives order confirmation via email. The Seller reserves the right to refuse orders in the following cases:
- product unavailability;
- obvious error in price or description;
- suspected fraudulent use of the website.
If one or more products are unavailable, we reserve the right to contact you to suggest an alternative. If a suitable solution is not found or if there is no interest in a replacement, we will refund any amounts already paid.
6. Prices
All prices are expressed in Euros (€) and include VAT. For sales to other European Union Member States, VAT is applied according to current European e-commerce regulations, including, where applicable, the application of the OSS (One Stop Shop) regime. No customs duties are foreseen for shipments within the European Union. Shipping costs are indicated separately before order confirmation. The price applied will be that indicated at the time the order is placed.
The Seller reserves the right to change prices at any time. The price indicated at the time of the order will be binding.
7. Payment Methods
Payment can be made using the methods indicated on the website. Transactions are managed through secure payment platforms. The Seller does not have access to the complete data of the cards used.
8. Shipping and Delivery
Orders are processed by our team within 3-5 business days from order confirmation. The shipping times indicated by the courier begin exclusively from the moment the package is handed over to the carrier and should therefore be considered in addition to the order processing times.
Deliveries are made to the European Union countries indicated on the Website. Delivery times are indicative and not binding, unless otherwise agreed. The risk of loss or damage to the products transfers to the Customer when the latter acquires physical possession of the goods.
9. Right of Withdrawal
The Customer has the right to withdraw from the contract within 14 days from the day on which they acquire physical possession of the goods, without obligation to provide a reason.
Withdrawal must be exercised by an explicit statement sent to the Seller's contact details or by sending a written communication to: info@nuleworld.com.
10. Return Conditions
The customer must return the products within 14 days of communicating withdrawal. Products must be:
- unused;
- intact;
- complete with original tags;
- returned in original packaging.
Returns will not be accepted if the original tags are removed or altered, except for mandatory rights provided by legal conformity warranty regulations.
The direct costs of returning are borne by the Customer, unless otherwise indicated on the Website.
11. Refund
The refund is made within 14 days of receipt of the goods. The refund will be made using the same payment method used for the purchase.
The Seller refunds: the product price and the original standard delivery costs. Any additional costs resulting from choosing a delivery method other than the standard one offered are not refunded. The Seller may deduct from the refund an amount corresponding to the decrease in the value of the goods resulting from handling other than that necessary to establish their nature, characteristics, and functioning.
12. Exceptions to the Right of Withdrawal
The right of withdrawal is excluded in cases provided by law, including:
- products customized at the customer's request;
- goods that have been used or damaged due to causes not attributable to the Seller.
13. Legal Guarantee of Conformity
All products are covered by a 24-month legal guarantee of conformity from delivery, pursuant to Directive (EU) 2019/771 and national implementing legislation. In the event of a lack of conformity, the customer has the right, free of charge, to:
- repair or replacement of the product;
- alternatively, price reduction or termination of the contract in cases provided by law.
The Customer is obliged to report the defect within the terms provided by applicable law. The mandatory rights of the consumer provided for by the law of the member state of residence remain unaffected.
14. EU Regulation 2018/302 (Geoblocking)
Nule does not apply unjustified discrimination based on the nationality, place of residence, or place of establishment of the Customer within the European Union, subject to objective limits related to logistics or current legislation.
15. Technology platform
The Website is built using e-commerce infrastructure provided by Shopify. Shopify exclusively provides hosting and technical management services for the platform. The Seller remains solely responsible for contractual relationships with the Customer.
16. Use of the Website
The customer undertakes to use the website exclusively for lawful purposes and not to engage in activities that could compromise its operation or security.
17. Intellectual Property
All content on the Website, including trademarks, images, texts, designs, and logos, are the exclusive property of the Seller. Any unauthorized reproduction, distribution, or use is prohibited.
18. Personal Data Processing
The processing of personal data is governed by the Privacy Policy and the Cookie Policy published on the Website, drafted in accordance with Regulation (EU) 2016/679 (GDPR) and applicable legislation.
19. Limitation of Liability
The Seller is not responsible for indirect or consequential damages arising from the use of the products or the Website, for delays or disruptions attributable to force majeure, unforeseeable events, or carrier liability. In any case, the mandatory rights of the consumer provided by law remain unaffected.
20. Applicable Law and Competent Court
Contracts concluded through the Website are governed by Italian law. If the Customer resides in another Member State of the European Union, they benefit from the protection provided by the mandatory rules of their State of residence. For disputes, the court of the consumer's place of residence or domicile is competent.
21. Amendments to the Conditions
The Seller reserves the right to amend these Conditions at any time. The amendments will take effect from the date of publication on the Website and will apply to orders placed after that date.
